How Long Do Points Stay on My Driving Record in New York?
When you are convicted of a driving offense in New York, points are added to your driving record. Accumulate too many in too short a time, and you risk losing your license. This system changed significantly in February 2026 — and the new rules are stricter than ever.
The New Suspension Threshold (Effective February 16, 2026)
Under New York’s updated DMV point system, which took effect February 16, 2026, points now stay on your record for 24 months from the date of the offense — up from the previous 18-month window. At the same time, the suspension threshold dropped from 11 points to 10 points within 24 months, meaning drivers now have a lower limit before facing suspension. Points are calculated based on the date of the violation, not the date of conviction — so a pending trafic court case will not stop the clock.
Updated Point Values for Common Violations
Now many violations carry higher point totals than before. Reckless driving and passing a stopped school bus now result in 8 points, up from 5. Cell phone use while driving increased to 6 points, and failure to yield to a pedestrian rose to 5 points. Speeding up to 10 mph over the limit now carries 4 points, up from 3. Speeding in a work zone now results in 8 points regardless of speed — a brand-new category.
For the most serious violations: speeding 31–40 mph over the limit carries 8 points; speeding more than 40 mph over the limit carries 11 points — enough to trigger suspension on a single ticket. Aggravated Unlicensed Operation (AUO) — driving on a suspended or revoked license — now carries 11 points, where it previously carried zero. DWI and other alcohol- or drug-related convictions also now carry 11 points each.
